US (CO): Firm mislabels product, gets issued a health and safety advisory

The Colorado Department of Revenue (DOR), in conjunction with the Colorado Department of Public Health and Environment (CDPHE) and Medically Correct, LLC., is issuing a health and safety advisory due to the mislabeling of a Retail Marijuana Product manufactured by Medically Correct LLC (DBA Medically Correct). The CDPHE and DOR deem it a threat to public health and safety when marijuana is found to be incorrectly labeled as established in MED Rule 3-1015(B)(3)(a).

Medically Correct LLC/(DBA Medically Correct) has self-reported that some of a Production Batch of Edible Retail Marijuana Product packages were confirmed to have been incorrectly labeled. This Production Batch is listed below.

The packaging of the multi-serving chocolate bar indicated each individual serving as “5mg THC: 5mg CBD” per piece when the package contained 10 individual servings of 10mg THC: 10mg CBD. The multi-serving bar was correctly stamped as 10 mg per serving on each piece, and the required labeling for potency and testing results are correct.

The Production Batch was documented as having been produced on September 16, 2020. Edible Marijuana products derived from these Production Batches were sold in Retail Marijuana Stores between October 8, 2020 and February 8, 2021.

Consumers who have these incorrectly labeled products in their possession should return them to the retail store from which they were purchased for proper disposal. Consumers who experience adverse health effects from consuming the product should seek medical attention immediately and report the event to the store from which they purchased the product.

All containers of affected marijuana should have a label affixed that, at a minimum, indicates the license number of the Retail Marijuana Business that cultivated the marijuana as well as the Production Batch number assigned to the marijuana. Consumers should check the label of their Edible Retail Marijuana Product for the following license number and Production Batch numbers.
