US (NY): Schoharie cannabis growers granted use variance for Amsterdam facility

A longstanding "eyesore" may be poised for rejuvenation after a use variance was granted allowing cannabis cultivation, processing and distribution in an existing West Main Street building. The decision eliminates the planned inclusion of an on-site retail shop.

Mt. Marcy Farms, proposed by Karker, Hess and Davis LLC in the former AeroMed building at 251 W. Main St., originally included plans for a small retail space to sell cannabis produced at the facility to comply with city code.

The on-site retail element was actually required for the overall proposal to be eligible for a special use permit in the commercial corridor zoning district, which does not allow cannabis manufacturing on its own.

Applicants agreed to seek a use variance to solely pursue plans for cannabis cultivation, processing and distribution at the site after members of the Planning Commission worried about the impact of on-site retail on the surrounding residential neighborhood.
