US (NJ): Court ruled residents' opposition to the cannabis facility was protected by the First Amendmentt

A state appellate court has upheld the dismissal of a lawsuit brought by a potential cannabis cultivator against a citizens group and three residents who opposed the plan.

The appellate court ruling on Oct. 15 upheld the dismissals of litigation brought by The NAR Group against the Save Lebanon Township Coalition, Richard Webb, William Bohn and Robyn Davidson.

The appellate court agreed with a lower court ruling that the opposition was protected under the First Amendment of the U.S. Constitution.

Webb is running on the Republican ticket for two three-year seats on the Township Committee with incumbent Beverly Koehler. They are opposed by Democrats Emmett Angell and Robert Foster.

The appellate court ruling is the latest chapter in The NAR Group's four-year legal battle to open a cannabis cultivation facility on Anthony Road.
