When Metrc was awarded the contract to provide Missouri's medical cannabis seed-to-sale tracking system, the price of its proprietary radio-frequency identification tags was not included.
It cannot charge consumers for them now, Missouri's Western District Court of Appeals ruled Tuesday.
The appeals court looked at the contract between Metrc and Missouri's Office of Administration as a whole, rather than an isolated section highlighted by Metrc when it brought its case, Judge Cynthia L. Martin wrote in her opinion.
Metrc received the contract with the state in April 2019.
Metrc's proposal originally included the cost per month for its system, noting it would be "industry paid." So, the costs of the RFID tags would be a burden on medical cannabis growers, sellers and product makers, and any patients or caregivers growing plants in their home, and not on the state.
