US (OH): Lighting company sued over explosion in cannabis facility

An Ohio cannabis manufacturer and its insurer are suing a lighting products provider for negligence after a lamp it sold exploded at a greenhouse, causing six figures worth of damages.

Cure Ohio and Dorchester Insurance filed a complaint last week in Franklin County against Eye Lighting International of North America for allegedly failing to warn of the dangers of using a lamp and lighting fixture together. On February 26, 2022, a lamp manufactured by Eye Lighting exploded at a Cure facility in Columbus, resulting in glass shards falling on the grow facility tables and crops. The complaint says the glass shards from the explosion came in contact with the plastic and biological material, creating smoke and contaminants.

As a result of the explosion and spread of smoke and contaminants, Cure incurred losses of $884,000. Dorchester fully paid the insured's claim. Plaintiffs are seeking said amount plus any additional proven damages and court costs. The complaint alleges the explosion was a direct result of negligence and failure to warn by Eye Lighting.

"Defendant knew and/or had reason to know of facts which created a high degree of risk of physical harm to others from the continued distribution of the lamp and fixture without a proper warning," the complaint says. The plaintiffs allege that Eye Lighting ignored the risk of its products and continued distributing and supplying the lamp and fixture.
