Health Canada plans to share document about health products containing CBD this fall

This fall, Health Canada is anticipating sharing a policy consultation document about health products containing (CBD). This proposal has been in the works since 2019.

In 2022, Health Canada released a report on health products containing cannabis.

Health products containing cannabidiol that would not require practitioner oversight will get a new regulatory pathway created by Health Canada as indicated in their Forward Regulatory Plan: 2024-2026.

New amendments created

In June of 2021, to better protect young people, Health Canada consulted with the public on proposed amendments to the Cannabis Regulations. These amendments would restrict inhaled cannabis extracts with certain flavours, other than the flavour of cannabis itself. These restrictions apply to producing, selling, promoting, packaging and/or labelling the products.

Health Canada initiated a legislative review of the Cannabis Act, after publishing these proposed amendments. Stakeholders identified a number of issues and concerns with the regulation of cannabis products as noted in the Expert Panel's What We Heard report. A final report to the Minister of Health, and the Minister of Mental Health and Addictions and Associate Minister of Health. This report was tabled in both Houses of Parliament on March 22, 2024.

Final recommendations are currently being examined before determining how to proceed with any further restrictions on flavours in cannabis extracts.
