US (DE): State House to vote on how counties can control cannabis businesses

One of the most significant hurdles for the marijuana industry in Delaware has been local restrictions, but a bill that is moving through Dover could soon change that.

Senate Bill 75, a response to the restrictive zoning laws that essentially choke out the marijuana industry in Sussex County, has passed out of its home chamber and is ready to be voted on in the House. New Castle County is also restrictive, but not nearly as much as Sussex. Kent County is the least restrictive county for marijuana businesses.

In Sussex, the county restricted the industry by zoning retail businesses for "Heavy Commercial" areas and keeping them 3 miles away from churches, schools, substance abuse facilities, municipal boundaries and other marijuana businesses. Municipalities like Lewes and Rehoboth Beach have gone ahead and banned retail marijuana already, as they are legally allowed to do.

The county does allow cultivation, manufacturing and testing facilities in "Heavy Commercial Districts."
