US (RI): State Control Commission sued over license confusion

Four years after losing a lottery drawing for a coveted retail cannabis dispensary license to a competitor, the Rhode Island Compassion Center is suing the state's Cannabis Control Commission in Superior Court, saying it should be given the license instead.

In its complaint, the Compassion Center alleges that the Rhode Island Cannabis Commission entered into a "back-room secretly negotiated consent agreement with Green Wave [Compassion Center] that violates statutory authority ... [and] the CCC's own regulations."

Even more basically, the lawsuit filed by Leslie Parker at Adler Pollock & Sheehan alleges that the consent agreement "creates exceptions" to the commission's compassion center and licensure requirements that are "solely for Green Wave."

The most recent example, according to the lawsuit, is that state cannabis regulators recently granted Green Wave another extension to allow variances to their initial application. The complaint argues that the changes allow Green Wave to "essentially create an entirely new application from that submitted in 2020."
