CAN: Town of Pelham, Redecan heading to court over odor issues

It will be the beginning of next year before the Town of Pelham and Redecan settle their differences over management of cannabis odors emanating from the Redecan's facility on Foss Road. That is unless the Town and the cannabis producer can reach an agreement in advance of a Jan. 21-23 hearing.

OLT member Steve DeBoer, who chaired the 30-minute case conference meeting Monday, thought a January hearing date would give both sides "sufficient time to possibly come to a resolution before we get to an actual hearing date."

DeBoer noted that Redecan and the Town had agreed on two of three terms and conditions, two of which mutually agreed upon between Redecan and the Town, said Brian Duxbury, Redecan's lawyer.

"But there was a third condition in respect to an odour management plan and some mitigation requirements around odor reduction that have taken some time to address with the Town, Duxbury added. "We thought in the last attendance that we would have that addressed so that we might be able to finalize this matter today. That has not happened."
