US (MA): Neighbors want permit for cultivation facility denied

The original special permit for Jon Piasecki's Wiseacre marijuana cultivation facility is up for its annual three-year renewal at Tuesday night's hybrid remote Planning Board meeting. But a group of seven Richmond and four West Stockbridge neighbors is aiming to snuff out the renewal through a formal 72-page opposition document filed by their attorney, William E. Martin of Martin Law Offices in Lenox.

Martin told The Eagle that when the original permit was granted, "it was kind of crazy, it really flew under the radar screen."

The facility called Wiseacre is at 42 Baker St., near the Richmond town line. Some area residents, including those in the Neighbors Advocating for Fresh Air coalition, have complained of marijuana odor during the plant harvesting season from mid-August to late October.

Other issues the group has raised include noise from fans installed by Piasecki to disperse odor, as well as community impact and legal compliance. Piasecki and his attorney termed the opposition "harassment" and insisted Wiseacre abides by very stringent regulations.
