US (MA): Developer of huge cannabis farm in Charlton wins court appeal

The state appellate court has upheld a Land Court decision that cannabis farm developer Valley Green Grow has the right to site a 1-million-square-foot grow operation on an apple orchard.

The 2-1 decision by a three-judge panel said the town Planning Board exceeded its authority in rejecting the developer’s site plan and has remanded the matter back to the town.

But winning its case in the appellate court does not clear the way for Valley Green Grow to unpack the shovels.

The developer’s subdivision plan that froze the zoning on the 94-acre orchard was also rejected by the Planning Board and an appeal on that decision is before the state Land Court. The next court date is July 22.

If Land Court sides with Valley Green Grow in its appeal, the project may move forward. If the appeal is denied, the grandfathered zoning will be lost, thereby halting the project.
