US (NY): Wilson Village facility site raises questions

The developer of a cannabis cultivation and distribution facility has been trying to pitch his proposed business operation to village officials in Wilson since March, but a recent legal opinion on zoning may stop him in his tracks.

Tom Maxwell, the owner of Northern Lights of Niagara, has asked to open an indoor growing facility for recreational marijuana in the same building the former Hamilton and Clark Funeral Home once inhabited on 268 Young St.

Currently, Maxwell has a license from the Office of Cannabis Management, that was issued in June to operate an adult-use micro-business where wholesale distribution and cultivation will take place. He also believes a retail component could be added later.

Unfortunately for Maxwell, Andrew Vona, the village's attorney has advised a member of the Village's Zoning Board of Appeals that it's believed that the business is not a permitted use within a central commercial district, and that the license is not relevant in passing village regulations.
